Yearly Membership: Payment entitles student to:
(1) Participate as a member in the TaeKwonDo program offered at The Workout Place.
(2) Use facilities and services offered in conjunction with the TaeKwonDo program.
(3) Enjoy member discounts on affiliated programs, merchandice and services.

Tuition: Payment reserves student’s space in all regularly scheduled TaeKwonDo classes consistent with student’s ranking.
(1) Family Discounts: 2nd Member-10%, Additional members-50% (May not be combined with any other discount offer).
(2) Ten-Month Year: Discounted rate available for students who plan not to attend during summer.
(3) Black Belt Rate: Discounted rate for black belts. (May not be combined with any other discount offer).

BILLING AGREEMENT

  1. I understand that I am responsible for the total invoice amount shown above and agree to pay this amount in full, including any applicable service and or late charges, irrespective of whether I (my child) make(s) full use of the instruction or facilities to which I am (my child is) entitled.

  2. Unless informed otherwise in writing, The Workout Place should assume that I wish to renew my (my child’s) membership and or/or instruction and may automatically renew or extend my expired membership and/or tuition agreement(s). 

  3. In the event that I have (my child has) taken classes beyond the lapsing date of this agreement and I choose not to renew this agreement, then in the absence of any other existing agreement, The Workout Place should bill me and I agree to pay the amount of $20.00 per class taken or $135.00 per month attended (whichever amount is less).

REFUND AGREEMENT

  1. I understand that I may cancel this agreement within 72 hours and receive a full refund of monies paid (except for equipment). Thereafter, I understand that this agreement is in full force and I agree to be responsible for payment of any outstanding balance due under the terms of this agreement.

  2. In the event that I wish to terminate instruction after the initial 72 hours, I understand and agree that I will be entitled to a refund of the unused portion of my tuition payment only (not membership or equipment).

  3. Furthermore, I understand and agree that any such refund will be calculated by applying a $135 per month tuition charge for each month or partial month of my (my child’s) attendance. I further understand and agree that for the purpose of this calculation attendance will be considered active until such time that The Workout Place has received written notification from me to the contrary, irrespective of my (my child’s) use of Workout Place facilities and services. Should the above calculation leave an outstanding balance, I agree to be responsible for any such outstanding balance due, including any applicable service and late charges.

 

LATE PAYMENT

  1. Payments received 10 or more days past the date due are considered late. In the event that my payment is late, I agree that The Workout Place may at its discretion, deny me(my child) access to instruction and use of facilities until my (my child’s) account is current.

  2. Furthermore, I agree that such denial of access on the part of The Workout Place will not affect my obligations under the terms and conditions of this agreement nor will it entitle me (my child) to an extension of the lapsing date of my (child’s) tuition or membership period(s).

  3.  I further agree to pay The Workout Place interest at the rate of 1.25% per month on all overdue accounts as well as any and all reasonable costs of collection including attorneys fees.
     

**SURCHARGE: I agree to pay a surcharge of $5.00 for each additional recordkeeping event occurring as a consequence of my decision to make split payments.


WAIVER: The failure of either party to insist upon strict performance of any of the provisions of this agreement shall not be construed as a waiver of any subsequent default.

CAPTIONS: The captions used herein are inserted only as a matter of convenience and for reference and shall not affect the construction and interpretation of this agreement.

SEVERABILITY: If any provision of this agreement is held to be unenforceable, all other provisions will nevertheless continue in full force and effect.

FORCE MAJEURE: Should the due performance of this agreement by The Workout Place be affected by reason of any matter or cause beyond the control of said party, said party shall be under no liability for any loss, damage, injury or expense suffered by the other party, and performance shall be suspended until it be practicable to recommence performance at which time this agreement shall again become operative in all respects.

BY SIGNING BELOW I ACKNOWLEDGE THAT I HAVE READ ALL TERMS, CONDITIONS, AND STATEMENTS ON BOTH SIDES OF THIS AGREEMENT AND UNDERSTAND, ACCEPT, AND AGREE TO ALL TERMS, CONDITIONS, AND STATEMENTS MADE HEREIN.

MEMBERSHIP AGREEMENT I hereby enroll (my child) for membership in The Workout Place. In consideration of my (my child) being accepted as a member, I agree (1) that my (my child’s) use of any equipment and services provided under the terms of this agreement is done at my (my child’s) own risk. Accordingly I agree not to hold The Workout Place responsible for any injury, loss, or damage which I (my child) may sustain as a result of my (my child’s) use of such equipment or services; and (2) that the management of The Workout Place may, at its discretion, limit or totally revoke my (my child’s) membership privileges, when it deems my (my child’s) use of the facilities to be unsafe, disruptive, or otherwise inappropriate. In the event that my (my child’s) membership is revoked, I agree to accept a prorated refund of my membership fee as full compensation for my (my child’s) loss of membership privileges; and (3) to assume responsibility and compensate The Workout Place and those affiliated with the school, for any damages to person or property resulting as a consequence of my (child’s) inappropriate, careless, and/or negligent activity; and (4) not to hold The Workout Place responsible for any loss, theft, or damage occurring to my (my child’s) personal property; and (5) to indemnify and/or reimburse The Workout Place along with any of its instructors, administrators or shareholders for all costs and obligations (monetary or otherwise) incurred by The Workout Place, its instructors, administrators, or shareholders, as a result of an action brought or an award granted any party, if at all related to my (my child’s) contact to that party, in connection with my (my child’s) participation in a Workout Place program; and, (6) that any photographs, films, slides furnished by me (my child) or taken of me (my child) can be used for publicity, promotion, television, news releases, publication and/or media that the promoters (The Workout Place) deem proper and necessary. I further waive on behalf of myself and/or my child any compensation in regard thereto.

I understand that my payment entitles me (my child) to attend all regularly scheduled TaeKwonDo classes appropriate to my (my child’s) age and rank for the tuition period indicated. I understand that under the terms of this agreement the Workout Place agrees to provide me(my child) the opportunity to attend a minimum of 8 classes per month. In consideration for my (my child)being permitted to participate in TaeKwonDo activities I agree to all terms listed below: RULES AND REGULATIONS: I hereby agree that I (my child) will abide by the rules, regulations and policies of The Workout Place and further agree that failure on my (my child’s) part to abide by the rules, regulations and policies of The Workout Place, and/or to comply with the instructions of officers or instructors of The Workout Place, will constitute sufficient grounds for which I (my child) may be denied further instruction or use of facilities under the terms of this agreement. In such an event, I agree that no refund will be due me(my child), nor will I be released from paying The Workout Place amounts due under the terms of any agreement existing between myself (my child) and The Workout Place. RANK PROMOTION: I understand that in order to be eligible for rank promotions, I (my child) must attend a minimum number of classes or instructional sessions and to demonstrate to the satisfaction of my(my child’s) instructor, the competencies set for each kup (belt) level. I agree that failure on my (my child’s) part to attend the required classes or to satisfy the kup requirements as determined by my (my child’s) instructor will not entitle me (my child) to a refund, compensation, or other adjustment, nor will I be released from paying The Workout Place amounts due under the terms of any agreement existing between myself (my child) and The Workout Place. CLASS CANCELLATION: I understand that the Workout Place reserves the right to periodically modify its schedule and to cancel classes due to inclement weather, insufficient enrollment or other hardship condition. So long as The Workout Place provides me (my child) an opportunity to attend a minimum of eight classes per month, I agree that no refund or extension or make-up of classes will be due me (my child), nor will I be released from paying The Workout Place any and all amounts due under the terms of any agreement existing between myself (my child) and The Workout Place. MAKE-UP POLICY: I understand that there are no make-up classes provided under the terms of this agreement. I further agree that I(my child) will not be entitled to a refund, extension or other adjustment because of my(my child’s) failure or inability to use the services or facilities to which I (my child) entitled. SPARRING: I understand that sparring exercise is a normal and expected activity inherent to TaeKwonDo training and that my (my child’s) demonstration of satisfactory sparring skill is a requirement for my(my child’s) advancement within the TaeKwonDo ranking system. I hereby agree that I (my child) will cooperate with and abide by the following sparring rules: (1) Mandatory sparring equipment must be worn whenever sparring. Mandatory equipment includes mouthpiece, protective boots, gloves, headgear and groin protector. (2) All sparring is to be controlled. Light (noninjurious) contact to the torso and to protected areas of the head are permitted. (3) Permissible scoring/target areas include: (a) Front and Side of Torso (Above the belt only); and (b) Front and Side of Face or Head. (4) At no time are hard or full contact blows to any area of the body or head permitted. (5) No Contact to the Face is Ever Permitted (6) Students are not permitted to: (a) Sweep an opponent; (b) Kick or strike an opponent who is down; (c) Grab and/or hold opponent’s leg; (d) Make uncontrolled kicks or strikes (e.g., spinning back fist). (7) At no time are students to engage in unsupervised sparring, either on or off school premises. Furthermore, I agree to assume full responsibility for damage and injury resulting to person or property as a consequence of my (my child’s) failure to comply with these regulations. TUITION AGREEMENT ASSUMPTION OF RISK: I UNDERSTAND THAT TAEKWONDO TRAINING INVOLVES VIGOROUS EXERCISE AND PHYSICAL COMBAT. I HEREBY CERTIFY THAT I AM (MY CHILD IS) IN GOOD HEALTH AND THAT I KNOWINGLY AND WILLINGLY WISH (MY CHILD) TO UNDERTAKE TAEKWONDO TRAINING. IN DOING SO, I AGREE TO ASSUME ALL RISK INHERENT TO SUCH TRAINING AND RELEASE THE WORKOUT PLACE, ITS ADMINISTRATORS, STAFF MEMBERS, STUDENTS, GUESTS AND ALL OTHER AFFILIATED INDIVIDUALS FROM ANY RESPONSIBILITY FOR INJURY DAMAGE, OR LOSS WHICH I (MY CHILD) MAY SUSTAIN AS A RESULT OF MY (CHILD’S) PARTICIPATION IN THE ACTIVITIES AND EXERCISES ASSOCIATED WITH MY (MY CHILD’S) TRAINING, INCLUDING BUT NOT LIMITED TO MY USE OF EQUIPMENT PROVIDED OR SOLD TO ME (MY CHILD) IN CONNECTION WITH MY (MY CHILD’S) TRAINING.

In purchasing this equipment, I agree to hold The Workout Place harmless and to waive and forever discharge any claim against The Workout Place and those associated with its operation for any injury, loss or damage which I (my child) may suffer as a result of my (my child’s) use of equipment sold or provided to me (my child) by The Workout Place. EQUIPMENT AGREEMENT I HAVE EXAMINED THE EQUIPMENT BEING PURCHASED AND AGREE TO PURCHASE IT AS IS. I UNDERSTAND THAT MY PAYMENT FOR THIS EQUIPMENT IS NON-REFUNDABLE AND THAT THE WORKOUT PLACE MAKES NO CLAIM, GUARANTEE OR WARRANTY AS TO THE SAFETY, DURABILITY, RELIABILITY OR SUITABILITY OF ANY OF THE PRODUCTS WHICH IT SELLS.
